Terms of Service

• "Customer" means the educational institute or organisation that subscribes to ShikshaOS.
• "User" means any individual (admin, staff, teacher, parent) authorised by the Customer to access ShikshaOS.
• "Data" means all information submitted to ShikshaOS by the Customer or its Users.
• "Service" means the ShikshaOS web application and related services.

The Service is intended for use by registered educational institutions and their authorised personnel. By using ShikshaOS you represent that you are authorised to bind the Customer to these Terms.

• You are responsible for maintaining the confidentiality of your login credentials.
• You must immediately notify us at support@shikshaos.in of any unauthorised account access.
• You are responsible for all activity that occurs under your account.
• You must not share credentials between Users or use another User's credentials.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable Indian law.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble the Service.
• Transmit any malicious code, virus, or disruptive data.
• Use the Service to store or process data that violates the rights of any third party.
• Resell or sublicense the Service without our prior written consent.

All Data you submit to ShikshaOS remains your property. We do not claim ownership of your Data. You grant us a limited licence to host, store, and process your Data solely to provide the Service. Upon termination, you may request an export of your Data within 30 days.

• Subscription fees are billed as agreed in your service order or invoice.
• All fees are exclusive of applicable taxes (GST) unless stated otherwise.
• Failure to pay within the agreed period may result in suspension of access.
• Fees are non-refundable except as required by applicable law or expressly agreed in writing.

We target 99% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party services (Supabase, Vercel, Twilio, etc.) or events outside our reasonable control.

ShikshaOS and all associated software, designs, and trademarks are the property of Zynverse Technologies. These Terms do not grant you any ownership rights in the Service. Feedback or suggestions you provide may be used by us without obligation to you.

Each party agrees to keep the other's confidential information (including pricing, technical details, and Data) confidential and not to disclose it to third parties without prior written consent, except as required by law.

To the maximum extent permitted by applicable law, Zynverse Technologies shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability shall not exceed the fees paid by you in the three months preceding the claim.

You agree to indemnify and hold harmless Zynverse Technologies and its directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, your Data, or your violation of these Terms.

• Either party may terminate the subscription with 30 days' written notice.
• We may suspend or terminate immediately for material breach of these Terms.
• Upon termination, your access is revoked and we will retain Data for 30 days before deletion unless you request an export.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mangalore, Karnataka, India. We encourage resolution of disputes first by contacting us at support@shikshaos.in.

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
